- Terms and Conditions of Business for Submissions
These are our standard terms and conditions. All items published are subject to these terms and may not be varied without our written consent. This is accepted as a legally binding agreement between www.booksanctuary.co.uk and the author[s] and/or owner[s] of the written material submitted to us for entry on our web-site.

Definitions
The Author[I/we] means the author[s] and/or the owner[s] and/or the agent[s] of the written material submitted.
www.booksancutary.co.uk [we/our] means the publishers and owners of this site and its owners in law. Currently this means the owners are the company Inclusive et al Limited (SC364952) -
Term of Agreement
This agreement shall come into force on the date of acceptance and publication by www.booksanctuary.co.uk and will be for the minimum period of 12 months. Once publication is agreed there are no costs for the author and Book Sanctuary will produce eBooks in three formats; pdf, ePub, and mobi. Royalties of 50% net profit are due for each eBook sale for the period of publication and signed agreement. Renewal for an additional 12 months is at the Author’s and www.booksanctuary.co.uk's discretion. -
Termination
www.booksanctuary.co.uk shall have the right to terminate this agreement with immediate effect in the event of the following situations:-
A complaint is made about the content of the written material that is published which www.booksanctuary.co.uk agrees is or may be justified.

A complaint is made about the ownership and rights to publish the written material that is submitted which www.booksanctuary.co.uk agrees is justified. www.booksanctuary.co.uk will have the final decision regarding this. No further royalties will be paid once termination takes place.

Responsibilities of the Supplier [www.booksanctuary.co.uk]
www.booksanctuary.co.uk will provide internet publication of fiction, poetry, short story collections, drama, advertisements and other articles in accordance with its own abilities and endeavours subject to the provision of services by its own suppliers. We are not liable to the Author for intermittent non availability of the web site. -
Damages Limitation
The amount of any damages recoverable by the Author from www.booksanctuary.co.uk for breach of contract or negligence shall be limited to outstanding royalties due to the Author. -
Responsibilities of the Author
The Author is responsible for the written works submitted being the property of the Author and indemnifies www.booksanctuary.co.uk, its owners, and its agents against any claims made against them from our publication of the material.
- Indemnities
The Author of the written material submitted hereby indemnify www.booksanctuary.co.uk against any criminal or civil action arising from the content of the submitted work.

Assurances & Guarantees from the Author
I/we assert and guarantee to www.booksanctuary.co.uk and readers of the material submitted that the work submitted is my/our own work, except where specifically stated otherwise, that I/we are the sole owner[s] to the rights to this work, and that I/we do not break the law by slandering, libeling, or defaming any living person, or by infringing racial abuse or other laws. -
Rights to Publish
The Author of the written material submitted hereby grant www.booksanctuary.co.uk non exclusive online digital rights and permission to reproduce and distribute, in whole or in part, in electronic media (internet), also to sell copies of the book [the material submitted at today’s date], for the duration of this agreement (12 months), in all languages. www.booksanctuary.co.uk do not have exclusivity or rights for print publishing of this material. -
Payments from www.booksanctuary.co.uk to the Author [Commissions]
Sales revenue will be shared on a 50% net profit paid to the Author of the material and 50% net profit retained by www.booksanctuary.co.uk.
Payments will be made retrospectively, every month, subject to sales achieving a minimum payment due to the Author of United Kingdom Pounds [£20.00] or Euros [30 Euros] or United States Dollars [USD 30.00]. Any amounts less than the amount shown in this paragraph will carry forward until the next monthly period, and subject to sufficient purchases of the publication being made then a remittance will be forwarded. Each party is to pay their own bank and/or credit card charges. The minimum level stated will be paid by www.booksanctuary.co.uk based on pound sterling exchange rate; international currency fluctuations may cause the amount received to be more or less than the amount sent. The Author accepts that the amount received may vary because of this. Upon termination of this agreement all outstanding royalties will be honoured by www.booksanctuary.co.uk. -
Discounts and Special Offers
From time to time and entirely at the discretion of www.booksanctuary.co.uk prices for books/publications may vary upwards or downwards and discounts may be offered on the price of the material for sale. The Author of the material submitted accepts and agrees that this may happen and accepts that this may lead to a different amount of commission but that the share of net profits will remain on a basis of 50% to the Author of the material and 50% retained by www.booksanctuary.co.uk. -
Ownership
The Author shall retain full copyright and intellectual property ownership of the material submitted. This will not change any of the Author’s obligations under this agreement. The published item, with regards to file formatting and typeset, will be owned by www.booksanctuary.co.uk. -
General
- The Author may not assign this agreement without first getting the written consent of www.booksanctuary.co.uk.
- All money amounts quoted are exclusive of applicable taxes.
- The customer’s rights are regulated by current UK law.
- The senior management of www.booksanctuary.co.uk reserve the right to refuse to accept an order from a customer without giving a reason to the customer.
- In the event of a sale of the business the rights of www.booksanctuary.co.uk are protected.

Governing Law
This Agreement is governed by UK Law and comes under the jurisdiction of the UK courts and legal system. However, in the event a clause is declared invalid or unenforceable that will not invalidate the agreement, save that an amendment will be made to make the clause legal and valid. It is agreed that if there is any legal dispute this is to be made in the United Kingdom only.
